A firm protested an Army contract award to another firm for models, technical data, and drawings for a radar warning receiver, contending that the Army: (1) abused its discretion in finding its best and final offer unacceptable; and (2) improperly accepted the awardee's firm, fixed-price offer when the solicitation called for a fixed-price-incentive contract. GAO held that the Army: (1) properly rejected the protester's proposal as unacceptable, even though it initially found it acceptable, since the protester made significant cost reductions without submitting a detailed explanation of their impact on its proposal; and (2) the protester's allegation that the Army improperly accepted the awardee's firm, fixed-price offer was without merit, since the Army informed offerers before bid opening that it would accept such a proposal. Accordingly, the protest was denied.
