Department of Transportation 1. The Secretary of Transportation should require the Administrator, FRA, to develop specific standards to guide its inspectors on how prosecutorial discretion is to be exercised within the framework of the Systems Safety Plan.
Closed - Not Implemented
DOT believes that a successful safety program depends on the inspectors' ability to exercise sound discretion in selecting enforcement tools at their disposal. Specific standards on how prosecutorial discretion is to be exercised would not allow the inspector to use his discretion.
