A firm protested a Navy reprocurement of pharmacy technician services, contending that the Navy improperly proceeded with a procurement under protest to the Armed Services Board of Contract Appeals. GAO held that: (1) the Navy had not issued a solicitation, which rendered the protest premature; and (2) a procurement pending a contract termination appeal was a matter which it would not consider. Accordingly, the protest was dismissed.
