[Protest Against Army Rejection of Bid for Modulator Assemblies and Transmitters]

A firm protested the Army's rejection of its bid for modulator assemblies and transmitters, contending that the Army unreasonably determined it to be nonresponsible by: (1) basing the determination solely on the negative recommendation of a preaward survey for prior contracts and on its lack of equipment; and (2) ignoring its updated information regarding its performance on a prior contract and its plans to develop the equipment for the instant contract. GAO held that the Army reasonably determined that the protester was nonresponsible based on: (1) concerns regarding its prior performance on three contracts; (2) its unconvincing explanations for contract delinquency; and (3) its unconvincing plans for acquiring equipment necessary for current contract performance. Accordingly, the protest was denied.
