[Protest of Any HHS Contract Award for Data Conversion Services]

A firm protested any Department of Health and Human Services contract award for data conversion services, contending that, even though it was the incumbent contractor, the agency failed to provide it with a copy of the solicitation prior to bid opening. GAO found that: (1) the agency twice announced in the Commerce Business Daily (CBD) its intention to issue a competitive solicitation for the same services; (2) the agency mailed solicitations to 77 firms, including the protester; (3) the protester's zip code on the agency's mailing list was incorrect; and (4) the agency received three timely proposals. GAO determined that: (1) the agency complied with the statutory and regulatory requirements to publicize the procurement; and (2) the protester had reason to know that its address on the agency's solicitation mailing list was incorrect. Accordingly, the protest was dismissed.
