[Protest of Army RFP Alleging Restrictive Specifications]

A firm protested that certain specifications included in a request for proposals (RFP) issued by the Army Contracting Agency for a quantity of document shredders were excessively restrictive and improperly limited competition. The firm alleged that the portion of the RFP relating to shredder capacity was unclear, but the agency formally denied this allegation. The agency subsequently rejected the protester's proposal as technically unacceptable and awarded the contract to another firm. GAO determined that the contentions made by the protester were untimely and not for its consideration since they raised new and independent issues that did not satisfy the timeliness criteria of its bid protest procedures. Accordingly, the protest was dismissed.
