A federal employee requested reconsideration of the denial of her claim for backpay and restoration of leave for the period she was placed on involuntary leave pending a decision on the agency-filed application for her disability retirement which was disallowed by the Civil Service Commission (CSC) initially and after two agency appeals. The employee was not entitled to backpay and restoration of leave from the date she was placed on leave to the date of the initial CSC action since the agency's action was in accordance with CSC regulations and was not an unjustified or unwarranted personnel action. However, she was entitled to backpay and restoration of leave from the date of the initial CSC denial of the agency's application to the date she was restored to active duty since the agency was obligated to either restore her to active duty or to take action to separate her pending the agency's appeal of the CSC determination.
