A firm protested a a Bureau of Indian Affairs (BIA) contract award for road construction, contending that BIA improperly allowed the awardee to submit a surety affidavit after bid opening. GAO held that BIA properly determined that the awardee's bid was responsive, since surety affidavit information did not relate to its obligation to perform in accordance with the solicitation. Accordingly, the protest was denied.
