A firm requested recovery of the costs of filing a protest against an Army determination of its nonresponsibility. GAO noted that, in an earlier decision, it recommended that the Army reconsider the nonresponsibility determination based on accurate information and award the contract to the protester after ensuring that it was responsible. GAO held that the protester was not entitled to recovery of filing and protest costs because it entered into a voluntary agreement with the Army and waived its right to the contract awards. Accordingly, the claim for costs was denied.
