[Appeal of Claims Group Denial of Claim for Refund of Money Withheld by Marine Corps]

A common carrier appealed the Claims Group's denial of its claim for monies that were withheld by the Marine Corps to pay for goods that were damaged while being transported by the carrier. GAO noted that after the goods were delivered the carrier received notice from the Corps of the damages. Since the carrier did not supply evidence demonstrating that the goods were not damaged while in its possession, it failed to disprove the Corps claim. Accordingly, the Claims Group's decision was affirmed.
