A firm protested the award of a contract for two chapel organs under a request for quotations issued by the Navy. The protester contended that Navy personnel specifically directed it to quote its larger and more expensive model which was in excess of the solicitation requirements and that the amended requirements of the solicitation were ambiguous; the Navy denied any such action by its personnel. GAO found that: (1) the protester failed to meet its burden of proving that the Navy directed it to exceed the solicitation requirements; and (2) the protest against the allegedly ambiguous amendments to the solicitation was untimely filed under bid protest procedures. Accordingly, the protest was denied in part and dismissed in part.
