The Defense Logistics Agency (DLA) requested a decision concerning airline promotional benefits received as a result of travel by Government employees on official duty. The issue in this case was whether DLA may establish procedures under which such benefits can be returned to the employee after it has been determined that the Government is not able to use them. GAO stated that Federal regulations provide for the disposition of promotional materials, not for the return of those benefits to the employee. The rationale for this determination is that the employee who received such benefits did so on behalf of the Government and has no property rights to them. Accordingly, DLA cannot set up procedures to return promotional benefits to an employee.
