Recommendation of Waiver of Recovery of Overpayment of Annuity Payments

A recommendation was received for waiver of recovery of annuity payments erroneously paid to the widow of [REDACTED] under P.L. 92-425 which provides for a minimum income guarantee for certain widows of former retired members of the uniformed service. The overpayment may not be considered for waiver pursuant to 10 U.S.C. 1453, as recommended, since that section was not applicable to P.L. 92-425. However, the head of the agency may terminate collection activity on the overpayment under the Code of Federal Regulations.
