Waiver of Recovery of Erroneous Annuity Payments

The agency recommended waiver of recovery of an amount representing annuity payments erroneously paid under statutes providing for a minimum income guarantee for widows of certain former retired members of the uniformed services. The overpayment was not for consideration for waiver pursuant to 10 U.S.C. 1453, but the agency may terminate collection activity on the basis of a determination of the debtor's inability to pay pursuant to the Code of Federal Regulations.
