Highlights

A firm protested a Patent and Trademark Office (PTO) contract award for data storage devices, contending that the PTO: (1) was unreasonable and inconsistent in evaluating the proposals; and (2) failed to conduct a fair and equitable competition. GAO held that PTO: (1) properly evaluated the proposals in accordance with the solicitation's evaluation criteria; and (2) was not required to meet certain regulatory requirements, since it placed its order under the Federal Supply Schedule. Accordingly, the protest was denied.
