Two firms protested a Defense Logistics Agency (DLA) solicitation for jet fuel, contending that the restrictive tank truck delivery terms resulted in a sole-source procurement. GAO held that DLA: (1) issued a competitive solicitation, but knew that only one firm could meet the restrictive requirements; and (2) did not comply with statutory and regulatory requirements for using noncompetitive procedures. Accordingly, the protests were sustained, and GAO recommended that DLA: (1) justify its use of noncompetitive procedures for the portions of its requirements that only one firm could meet; and (2) reimburse the protesters for their protest costs.
