A firm protested an Army solicitation for rifle components, contending that the Army improperly failed to award it a sole-source contract, since it had exclusive rights to the proprietary data regarding the components due to the government's breach of a license agreement. The government contended that it still possessed the right to use the technical data, since the agreement remained valid. GAO held that it would not review the protest, since its function was to ensure full and open competition. Accordingly, the protest was dismissed.
