A firm protested two Navy contract awards for ship repair, contending that the Navy: (1) improperly amended the solicitation after receipt of initial proposals; (2) improperly requested best and final offers (BAFO); and (3) alerted other bidders that it was in line for award during a preaward survey and created an auction. GAO held that the: (1) Navy properly amended the solicitation to incorporate negotiation provisions; (2) Navy properly requested BAFO, since it could not make award based on initial proposals after the amendment; and (3) Navy's preaward survey neither implied that the protester's price was not low nor constituted an auction in the absence of a price leak. Accordingly, the protest was denied.
