A firm requested reconsideration of its denied protest against the Defense Logistics Agency's (DLA) decision to restrict a solicitation for x-ray equipment to small disadvantaged businesses. GAO had held that the protester failed to show that DLA acted in bad faith. In its request for reconsideration, the protester contended that: (1) DLA acted in bad faith when it decided to restrict the solicitation after advertising it as a competitive small business set-aside; and (2) GAO failed to address its comments regarding another offerer's protest of the procurement. GAO held that the protester: (1) failed to show that DLA had specific or malicious intent to injure it; and (2) was not a party to the other protest, which concerned the Small Business Administration and was not subject to GAO review. Accordingly, the request for reconsideration was denied.
