A firm protested the Army's amendment of a solicitation for construction, contending that the Army's retroactive inclusion of a preference for small disadvantaged businesses was unfair to nondisadvantaged bidders. GAO held that the Army properly amended the solicitation to implement a procurement regulation requiring it to provide an evaluation preference for small disadvantaged businesses. Accordingly, the protest was denied.
