A firm protested the Veterans Administration's (VA) termination of a contract for periodical subscription services and a contract award to another firm under a resolicitation, contending that: (1) VA arbitrarily terminated its contract and resolicited in response to the awardee's untimely protest to GAO; (2) VA prejudiced it by reopening negotiations after discussions; (3) the awardee's offer was unbalanced; and (4) VA improperly requested best and final offers despite pending bid protests on the procurement. GAO held that: (1) VA properly terminated the contract and amended the solicitation after it determined that it prejudiced the awardee during negotiations; (2) VA did not improperly disclose any portion of the protester's proposal; (3) the awardee's offer would result in the lowest cost; and (4) VA was not prohibited from accepting offers while the protests were pending. Accordingly, the protests were denied.
