The International Association of Fire Fighters requested a decision regarding: (1) the Office of Personnel Management's (OPM) determination that three supervisory-level fire fighters employed by the Department of Defense were exempt from the Federal Labor Standards Act (FLSA); and (2) whether the fire fighters, who received premium pay for standby duty, were entitled to additional overtime pay. GAO held that: (1) it would not consider the question of the fire fighters' exempt status, since that was within the statutory authority of OPM; and (2) fire fighters were precluded from receiving additional overtime payment for work that was part of their normal duties. Accordingly, the claims were denied.
