A firm requested reconsideration of its denied protest against an Army contract award to another firm. GAO had held that the protester untimely filed its protest more than 10 working days after the Army's initial adverse action on its agency-level protest. In its request for reconsideration, the protester contended that its protest was timely because: (1) its counsel did not receive a copy of the agency denial until the day after the receipted date; and (2) a day when federal offices were closed because of snow should not have counted as a working day. GAO held that: (1) the protester's delay in advising its counsel of the denial was not a valid basis for extending the filing time for a protest; and (2) the snow day was a federal working day, since government offices in other locations were open. Accordingly, the original decision was affirmed.
