A firm protested a Navy contract award for bulkhead repair and construction, contending that the Navy improperly accepted the awardee's bid since: (1) it arrived after bid opening; and (2) improper government action was not the cause of the bid's late receipt. GAO held that, since the commercial delivery driver neither attempted to deliver the parcel to the bid opening room nor indicated any particular urgency to its delivery, improper government action was not the paramount cause of the bid's late delivery, and the Navy should have rejected it as late. Accordingly, GAO sustained the protest, and recommended that the Navy terminate the contract for convenience and make award to the protester, if otherwise appropriate.
