[Protest of DCSC Contract Award for Tractor Dozers]

A firm protested a Defense Logistics Agency (DLA) contract award for tractor dozers, contending that: (1) the award was improper because the awardee intended to novate it to another firm that was not an offerer; (2) the awardee's bid failed to meet a material solicitation requirement; and (3) it was entitled to the award as the low bidder because the awardee would manufacture its product in a country whose end products were not exempt from the Buy American Act. GAO held that: (1) since the novation was only to last as long as Libya retained any interest in the awardee's parent company, that portion of the protest was moot because Libya had sold its interest; (2) it would not review the DLA determination of the awardee's responsibility; and (3) it would not review the awardee's compliance with the Buy American Act since that was a matter of contract administration. Accordingly, the protest was dismissed in part and denied in part.
