[Protest of NASA Rejection of Proposal as Late]

A joint venture protested the National Aeronautics and Space Administration's (NASA) rejection of its bid for wind tunnel modifications as late, contending that: (1) NASA should have considered the proposal since it would have been in the government's best interest; (2) NASA failed to properly notify the public of changes to the Federal Acquisition Regulation; and (3) its bid was late because no NASA representative was in the room to receive the bid. GAO held that: (1) NASA properly rejected the protester's bid since it failed to meet any of the exceptions listed in the solicitation; (2) NASA changed its regulations and properly notified the public of its decision to disallow the consideration of late bids that might be in the government's best interest; and (3) the protester failed to show that NASA wrongfully delayed the receipt of its bid. Accordingly, the protest was denied.
