A motor carrier requested review of a General Services Administration (GSA) audit action that found that the carrier overcharged the Army for a shipment. The carrier contended that: (1) GSA improperly determined that a lower rate was applicable under the carrier's rate tender; and (2) the rate tender was not applicable to the specific destination to which it delivered the shipment in question. GAO held that: (1) the carrier was generally authorized to serve the destination in question; and (2) GSA improperly applied the lower tender rate to the shipment. Accordingly, GAO recommended that GSA issue a settlement based on the higher rate.
