A firm protested a contract award to another firm under an Army small business set-aside solicitation for washers and dryers, contending that: (1) the Small Business Administration had determined that the awardee was not a small business; and (2) the awardee's bid was nonresponsive because it either correctly certified the awardee as a large business or misrepresented it as a small business. GAO held that: (1) it would not consider the protest because the protester failed to timely protest the awardee's size status to the Army; (2) the awardee would be excluded from future procurements incorporating the same size standard as the instant procurement; and (3) there was no evidence that the awardee willfully misrepresented its size in its bid. Accordingly, the protest was denied.
