A firm protested a Veterans Administration small business set-aside contract award contending that: (1) the awardee was not regularly established in the business; and (2) the awardee would subcontract a large portion of the work to a firm that was not a small business. GAO held that: (1) it does not review affirmative determinations of responsibility absent a showing of fraud or that definitive responsibility criteria were not met, and neither exception applied in this case; (2) contract compliance is a matter of contract administration and not for GAO consideration; and (3) subcontracting with a large firm under a small business set-aside is not legally objectionable. Accordingly, the protest was dismissed.
