[Protest of Any VA Contract Award for Window Cleaning Services]

A firm protested any contract award under a Veterans Administration (VA) solicitation for window cleaning services. The protester contended that it was improperly deprived of the opportunity to bid because it did not receive a copy of the solicitation and alleged that VA had assured it that its name would be kept on a bidders list for use in future procurements. GAO found that: (1) VA published a notice of the procurement in the Commerce Business Daily (CBD); (2) the solicitation was issued to the names on the bidders list and to all the firms that responded to the CBD notice; and (3) the protester was not on the bidders list, nor did it reply to the CBD notice. GAO determined that the reliance on the alleged agency assurance that the firm's name would be kept on the bidders list did not constitute a reason to cancel the solicitation and resolicit since there was no evidence of the agency's deliberate effort to exclude it from competing. Accordingly, the protest was dismissed.
