A firm requested reconsideration of a decision which sustained its protest against a Department of Agriculture lease award, contending that GAO should have recommended termination of the lease because the awardee knew that the site it proposed was unacceptable and, therefore, acted in bad faith in tendering its offer. GAO held that, since there was no evidence that the awardee knew that the site it offered was unacceptable, and the lease did not contain a termination for convenience clause, termination could subject the government to unnecessary risk. Accordingly, the original decision was affirmed.
