A firm requested review of the General Services Administration's (GSA) deduction action to recover overcharges collected by an interstate carrier in connection with a household goods shipment. GSA determined that, although the carrier's shipping rate was initially accepted and paid by the Military Traffic Management Command, it was later found that the rate exceeded the maximum government payment. Further, since the tender stated that any charge that exceeded the maximum would not be paid, the government was not obligated to pay the total amount, and the carrier's rate was properly used to calculate the overcharge. Accordingly, the GSA deduction action was sustained.
