A firm protested the Army's cancellation of a small business set-aside. The Army had determined that the protester was the apparent low bidder; however, it decided to cancel the solicitation and issue a new solicitation because the specifications were inadequate. The protester stated that the Army's decision to cancel the solicitation after bid opening was arbitrary and capricious and should not be sustained. In this case, GAO found that the Army had a compelling reason to cancel the solicitation and that resolicitation would meet the minimum needs of the Army. Therefore, GAO found that the protester failed to prove that the Army's action was arbitrary or unreasonable. Furthermore, GAO would not consider a protester contention that acceptance of its bid would result in a monetary savings to the government. Accordingly, the protest was denied.
