A firm protested a Defense Logistics Agency (DLA) contract award, contending that DLA contracted for a different item than the one specified in the solicitation and that DLA failed to set aside the procurement exclusively for small business concerns. Bid protest procedures require that: (1) a bid protest must be filed within 10 working days after the basis for protest is known; and (2) a protest based upon alleged improprieties apparent on the face of a solicitation must be filed prior to bid opening. GAO found that, since the protest of the set-aside issue was filed after bid opening and the protest of the other issue was filed more than 10 days after the basis of protest was known, both were untimely filed and not for consideration. Accordingly, the protest was dismissed.
