A firm protested the Marine Corps' refusal to award it the remaining portion of a terminated contract, arguing that it was next in line for the award. The Corps had found that its initial evaluation of the awardee's bid improperly considered factors which overstated its minimum needs, so it terminated the remainder of the contract and resolicited. GAO held that, since the protester's bid was also improperly evaluated, resolicitation was a proper method to obtain bids which reflected the Corps minimum needs. GAO noted that there was no legal basis to pay the protester's claim for anticipated profits. Accordingly, the protest and the claim were denied.
