[Protest of Contract Award Under Navy RFP]

A firm protested the Navy's award of a contract under a request for proposals (RFP) for a pallet stacker system. The protester alleged that the awardee's storage racks did not meet the RFP weight capacity requirements and requested that the Navy test the awardee's system. The Navy stated that it based its determination that the awardee's system was acceptable on literature submitted with its proposal and asserted that whether the system actually performs as stated in the proposal is not a matter for GAO consideration. GAO found that: (1) the protester failed to show that the Navy acted unreasonably in finding the awardee's offer acceptable; and (2) there is no requirement that an agency test a product it has found to be technically acceptable merely because a disappointed offerer alleges nonconformity. Accordingly, the protest was denied.
