A firm protested the Navy's rejection of its bid for failure to comply with the delivery schedule set forth in the solicitation. The protester had submitted the low bid, but proposed to make delivery after the specified date. The protester maintained that it had made a mistake in its computations and that it fully intended to comply with the solicitation's delivery requirements. The protester also argued that the Navy should have corrected the mistake because it was an obvious error. GAO held that a bidder's intention to meet a solicitation's material requirements cannot render the bid acceptable if on its face it modifies the bidder's obligation to perform the contract. Regarding the protester's allegation that the items under the procurement were too complex to be procured through a solicitation, the protest was untimely. Accordingly, the protest was denied in part and dismissed in part.
