A firm protested the possible future actions of the General Services Administration (GSA) with regard to a contract GSA awarded to the protester. Prior to the protest, another firm had filed suit in a district court concerning the contract and, although the issues were not identical to those in the protest, they were part of the pending litigation because they were possible judicial remedies. GAO does not decide protests where the material issues involved are being considered by a court, unless the court expresses interest in such a decision. The court did not indicate such an interest. Accordingly, the protest was dismissed.
