A firm protested a contract award by the Defense Logistics Agency to another firm, contending that: (1) the solicitation specifications were confusing and inaccurate; and (2) the awardee was engaged in predatory pricing in violation of the Robinson-Patman Act. GAO held that: (1) the portion of the protest regarding the solicitation specifications was untimely filed; (2) the Robinson-Patman Act does not apply to Government contracts; and (3) the matter of predatory pricing concerned alleged antitrust violations which GAO does not consider. Accordingly, the protest was dismissed.
