A firm protested a Veterans Administration contract award, contending that the awardee was a large multinational corporation that was able to eliminate competition by underbidding small business concerns. GAO has held that, although it is Government policy to place a fair proportion of purchases with small business concerns, there is no applicable regulation or statute that a particular procurement must be set aside for small business except in limited circumstances not present here. GAO noted that the contracting agency's decision not to restrict the procurement was confirmed by the fact that only one small business bid on it. Further, GAO does not consider allegations of antitrust violations. Any allegation that the awardee is engaging in monopolistic practices should be referred to the Department of Justice. Accordingly, the protest was dismissed.
