[Protest of Any GSA Contract Award]

A firm protested any contract award to a particular bidder under a solicitation issued by the General Services Administration (GSA), contending that the bidder could not meet a solicitation specification that the product be manufactured wholly within the United States. GSA found that the bidder was responsible and that its bid samples were manufactured wholly within the United States, in accordance with the solicitation specification. GAO does not review affirmative determinations of responsibility unless there is a showing of fraud or bad faith or that the solicitation criteria were misapplied.The protester did not demonstrate fraud or bad faith, and GAO determined that none of the solicitation criteria were misapplied. GAO further held that it does not conduct reviews to determine the validity of a protester's assertions in a bid protest. Accordingly, the protest was dismissed.
