Highlights

A firm protested the award of a contract to repaint stripes on an airport runway under an Air Force invitation for bids which was a small business set-aside. The protester challenged the small business status of the awardee to the contracting officer, who referred the matter to the Small Business Administration (SBA). The protester complained that the Air Force did not wait for the SBA decision before awarding the contract. GAO found that the protester was not prejudiced by the contract award even though it was made 3 days before SBA was scheduled to make its determination, because SBA did confirm the awardee's small business size status. Accordingly, the protest was dismissed.
