GAO reviewed the Department of Defense, Department of the Army, Corps of Engineers and Environmental Protection Agency's (collectively, the agencies) new rule on the Clean Water Rule and the definition of "Waters of the United States." GAO found that (1) the final rule does not establish regulatory requirements, but, instead, defines the scope of waters protected under the Clean Water Act (CWA) in light of the statute, science, Supreme Court decisions, and the agencies' experience and technical expertise; and (2) the agencies complied with the applicable requirements in promulgating the rule.
