Pursuant to section 801(a)(2)(A) of title 5, United States Code, this is our report on a major rule promulgated by the Department of Health and Human Services (HHS), Centers for Disease Control and Prevention (CDC) entitled “Expiration of Interim Final Rule: Control of Communicable Diseases; Foreign Quarantine” (RIN: 0920-AA75). We received the rule on December 16, 2025. It was published in the Federal Register on December 4, 2025. 90 Fed. Reg. 55813. The stated effective date of the rule is December 4, 2025.
This rule announces the expiration of an interim final rule published in the Federal Register on February 12, 2020, 85 Fed. Reg. 7874, which amended CDC's Foreign Quarantine regulations during the COVID-19 public health emergency. According to CDC, the Secretary of HHS determined that there is no longer a need for the interim final rule. 90 Fed. Reg. 55813. Therefore, paragraphs (d) and (e) of 42 C.F.R. § 71.4 expired on November 21, 2025. Id. at 55814. CDC stated that paragraphs (a) through (c), which were finalized in 2017, shall remain. Id.
The Congressional Review Act requires a 60-day delay in the effective date of a major rule from the date of publication in the Federal Register or receipt of the rule by Congress, whichever is later. 5 U.S.C. § 801(a)(3)(A). The rule was published in the Federal Register on December 4, 2025. 90 Fed. Reg. 55813. The Congressional Record does not yet reflect the date of receipt by the Senate. According to documents submitted by HHS, the Senate received the rule on December 16, 2025. Email from Regulations Coordinator, HHS, to GAO, Subject: Official Submission - RIN 0920-AA75 (Dec. 16, 2025). The Congressional Record reflects that the House of Representatives received the rule on December 18, 2025. 171 Cong. Rec. H6112 (daily ed. Dec. 18, 2025). The rule has a stated effective date of December 4, 2025. Therefore, the stated effective date is less than 60 days from the date of receipt by Congress.

CDC stated in its submission to us that this rule contains information collection requirements under the Act. CDC stated in its submission that the PRA package associated with the 2020 interim final rule will be discontinued.
