GAO reviewed the Department of Commerce, National Institute of Standards and Technology's (NIST) new rule entitled "Preventing the Improper Use of CHIPS Act Funding." GAO found that the final rule implements conditions in the CHIPS and Science Act of 2022, Pub. L. No. 117-167, 136. Stat. 1372 (Aug. 9, 2022), that seek to prevent funding provided through the program from being used to directly or indirectly benefit foreign countries of concern.

Enclosed is our assessment of NIST's compliance with the procedural steps required by section 801(a)(1)(B)(i) through (iv) of title 5 with respect to the rule.
