Social Security Administration: Omitting Food From In-Kind Support and Maintenance Calculations

Highlights

GAO reviewed the Social Security Administration's (SSA) new rule entitled "Omitting Food From In-Kind Support and Maintenance Calculations." GAO found that the final rule (1) updates the Supplemental Security Income (SSI) regulations to remove food from the calculations of in-kind support and maintenance; (2) adds conforming language to SSA's definition of income; and (3) includes other minor revisions to SSA's regulations related to income, including clarifying its longstanding position that income may be received "constructively."

Enclosed is our assessment of SSA's compliance with the procedural steps required by section 801(a)(1)(B)(i) through (iv) of title 5 with respect to the rule. If you have any questions about this report or wish to contact GAO officials responsible for the evaluation work relating to the subject matter of the rule, please contact Shari Brewster, Assistant General Counsel, at (202) 512-6398.
