A firm protested a Navy contract award for construction work, contending that the Navy (1) unfairly terminated its contract with the firm and (2) improperly determined that it had initially had wrongly rejected the awardee's proposal for failure to include an anti-mafia certificate. GAO noted that the Navy (1) properly determined that it should not have rejected the low-priced offeror's proposal for failure to include certification with its initial proposal because certification could be submitted any time prior to award; and (2) after that firm furnished the statement, properly terminated the protester's contract and made award to the low-priced offeror. Accordingly, the protest was denied.
