A firm protested a Military Traffic Management Command (MTMC) contract award for intermodal containers, contending that MTMC: (1) failed to apply the Buy American Act policy in evaluating the awardee's proposal; and (2) improperly held discussions with the awardee. GAO held that: (1) MTMC was not required to hold discussions with the protester, since its proposal would need major revision to become acceptable; (2) the protester failed to allege improper conduct by MTMC; and (3) MTMC properly waived the application of the act, since the awardee's proposed products were made in a qualifying country, which is consistent with the provisions of the act. Accordingly, the protest was denied.
