A firm protested a Drug Enforcement Administration (DEA) contract award for information technology technical services, contending that DEA improperly failed to synopsize its requirement in the Commerce Business Daily and compete it among interested potential bidders. GAO held that: (1) the protester untimely filed after bid closing its protest of alleged solicitation deficiencies; and (2) it would not exercise its discretion to waive the timeliness requirements, since the protester had received orders and accepted benefits under the ordering provisions. Accordingly, the protest was dismissed.
