Highlights

A firm protested a Navy contract award, contending that its bid should not have been rejected as nonresponsive, since the solicitation specifications were impossible to meet. GAO held that: (1) the protester untimely filed after bid opening its protest regarding the solicitation specifications; and (2) it would not review the affirmative responsibility determination, since the protester could not provide evidence of fraud or bad faith. Accordingly, the protest was dismissed.
